In 1819 Foley had resumed his seat for Droitwich on the family interest, headed since 1793 by his cousin the 3rd baron, filling the vacancy caused by the death of his father the previous year. Like him he was a zealous Whig. At the 1820 general election he and another of Lord Foley’s cousins were returned unopposed.1 Berrow’s Worcester Jnl. 2 Mar. 1820. Foley had been seriously ill in 1818, and a relapse may account for his absenteeism during this period, when he is not known to have voted or spoken in debate. He died at Newport House in January 1822.2 Gent. Mag. (1822), i. 93. By his will, dated 19 Oct. 1820 and proved under £12,000, he directed that all residue should pass to his sister Anna and brother William ‘after my debts are paid’, but he was declared ‘insolvent’.3 PROB 11/1658/315; IR26/905/481.
